Student Records - Family Rights and Privacy Act (FERPA)

Bismarck State College maintains the following educational records that contain information directly related to students.

  1. Application material submitted by the student or sent to BSC at student request (Admissions Office).
  2. Financial Aid matter submitted by the student or sent to BSC at student request (Financial Aid Office).
  3. Account charges and receipts (Business Office).
  4. Records pertaining to academic or training achievement including transcripts and grade reports.
  5. Instructor's recommendation for vocational-technical students (Instructor's Offices).
  6. Records pertaining to on-campus housing (Student Union Office)

These records are on file in appropriate BSC offices and are accessible only to persons having legitimate interest as defined in Public Law 93-380. Information contained in student records will not be otherwise released without written consent from the student. For student records purposes, the College assumes that all students who wish to review the educational records of their dependent son or daughter must first establish the students' dependency as defined by Internal Revenue Code of 1954, Section 152.

With regard to educational records maintained by the College, the Family Rights and Privacy Act of 1974 guarantees students certain rights which include the following:

  • The right to inspect and review information contained in the educational records in their file.
  • The right to challenge the content of information contained in their educational records file.
  • The right to a hearing as part of an initially unsatisfactory challenge.
  • The right to submit a written explanatory statement for inclusion in their educational records file if outcomes of a challenge and hearing are unsatisfactory.
  • The right to prevent disclosure, with exception, of personally identifiable information.
  • The right to receive a copy of the College's policy regarding educational records maintained by the institution.
  • The right to file complaints with the Department of Education concerning alleged failure of Bismarck State College to comply with provisions of the Privacy Act of 1974.

The College may, in compliance with the law, or to protect the integrity of the institution, release the following directory information without consent:

  1. Name, address, and telephone listing.
  2. Sex and marital status
  3. Name and address of parents
  4. Major field of study
  5. Participation in officially recognized activities
  6. Weight and height of members of athletic teams
  7. Dates of attendance
  8. Degrees and awards achieved
  9. Most recent previous institution attended
  10. Classification as freshman, sophomore, or special student

Release of directory information is handled with discretion and is chiefly used for such purposes as press releases and research. In keeping with College policy, directory information may be released to other agencies for purposes of advertising. However, directory information concerning a particular student will be removed from release status upon written request from the student involved.

Educational records concerning a student may be reviewed upon request of the student. For student records purposes, the college assumes that all students are independent. Parents of dependent students must establish a student's dependency (Internal Revenue Code of 1954, Section 152), as a first step in gaining access to a student's educational records.
